We learned today that USCIS has used far less that the 65,000 annual allotment of H-1B cap subject visas during several of the past five years. According to USCIS statistics, it appears that 46,000 H-1B visas were not used during the past five years! In our global economy where recruiting the best and the brightest to create jobs for Americans is crucial, wasting at least 4,000 H-1B cap subject numbers is a glaring error with widespread negative impact. We suggest that this error be corrected immediately by reopening the H-1B pool now until the 46,000 H-1B numbers are taken. It also appears that USCIS may not be returning unused numbers to the H-1B quota pool and may not be returning visa numbers allocated to revoked or withdrawn petitions to the H-1B quota pool!
