USCIS Releases Q&A Print E-mail

USCIS has released Questions and Answer regarding the expedited name check procedures to eliminate the 47,000 delayed permanent residence applications.  The Q&A may be accessed at:  http://bibdaily.com/pdfs/name_check_faq-20feb08.pdf.  The new procedures permit CIS to adjudicate I-485 applications where the FBI name check has been pending 180 days or more with no response from the FBI.  We welcome this opportunity for our many clients stuck in name checks to obtain permanent resident status after months and often  years of delay.  It is anticipated that it will take several months for the backlog to be cleared up.  In many cases, the CIS will issue a notice for applicants to obtain new fingerprints as fingerprints expire after one year.  It is most important that all applicants who have moved since filing their I-485 application notify CIS online at uscis.gov and by mailing a Form AR-11, retaining a copy of the AR-11 and proof of mailing for your files.  Applicants should also note that CIS may contact employers or sponsoring family members to verify employment and/or continuing qualifying family relationship.  CIS may also request updated tax returns and job letters from applicants.  Contact us if you have questions about the procedures.  We are ensuring that the CIS has the names of all clients with I-485 applications pending more than six months who are delayed in security checks.
