New Procedures for I-90 Processing and Adjudication Print E-mail

The National Benefits Center (NBC) is now overseeing the processing and adjudication of Form I-90, as described below, with the following exceptions. If an applicant has selected as the reason for filing an I-90 as b, "My authorized card was never received" or d, "My card was issued with incorrect information due to a USCIS administrative error" then those applications will continue to be processed by the Service Center or NBC having jurisdiction as described in the I-90 instructions on the USCIS website.

For applicants who are eligible to file either electronically or at the Los Angeles Lockbox, fee payment is verified by the Lockbox and a biometrics appointment is scheduled for the ASC with jurisdiction over the applicant's residence.

If the ASC can verify/validate applicant's identity, then biometrics and fingerprints are processed. NBC adjudicates the I-90. If during the adjudications process it is determined that additional information is required the NBC will send an RFE requesting such evidence. An example of such request would be for proof of LPR status if information is not available in USCIS records or systems. All required security checks will be initiated and completed by the NBC as part of the adjudication process.

If the ASC cannot verify/validate identity or the permanent resident card appears to be fraudulent, then the ASC will transfer the I-90 to the Field Office with jurisdiction over the applicant's residence. The Field Office is responsible for final adjudication of these I-90s. The NBC provides a monthly report to headquarters and regions of all I-90s relocated from the ASC to the field offices. The NBC will work with the Field Offices to ensure timely adjudication of these I-90s.

If the applicant fails to appear for the ASC appointment (and has not rescheduled), then the I-90 will be denied for abandonment 90 days after the appointment date.

NBC expects the processing time for I-90s to be added to its processing time report for November 2008. After the processing time for I-90s has been added to the NBC processing time report, you may submit an inquiry through the AILA NBC Case Liaison Assistance process if (1) you are the attorney of record and (2) (a) the receipt date provided in the most recent NBC processing time report posted on the USCIS website for Form I-90s is at least thirty (30) days past the receipt date of your client's Form I 90 and your client has appeared at the ASC to have his/her fingerprint/photo taken or (b) more than sixty (60) days have elapsed since the receipt date of your client's Form I-90 and your client has not received a notice to have his/her fingerprint/photo taken.
