H-1B's exhausted, EB-2's to retrogress worldwide!

The unofficial word from USCIS is that USCIS exhausted H-1B cap subject numbers at 10:15 a.m. today! This means no further H-1B cap subject petitions will by accepted for the fiscal year October 1, 2012, until September 30, 2013.

In other bad news, the Department of State announced today that the worldwide employment-based second preference (EB-2) immigrant visa quota will retrogress to January 1, 2009 beginning on July 1, 2012.

However, EB-2 applicants may file their I-485 applications under the current Visa Bulletin, which indicates the category is “current” until June 30, 2012. Of course, the India and China EB2 category remain unavailable for July 2012 and the remainder of the fiscal year. It is critical that all I-485 applications which can be filed before July 1, 2012 be filed before midnight on June 30, 2012. Please contact This e-mail address is being protected from spambots.
